Four persons who had been charged over the Ksh.3.5 billion Anglo Leasing scandal are now free.

An anti-corruption court in Milimani has acquitted former Treasury PS Joseph Magari, Dave Mwangi and David Onyonka and businessmen Deepak and Rashmi Kamani of conspiring to defraud the government of Sh3.5 billion in the Anglo Leasing case.

Chief Magistrate Martha Mutuku cleared the four of the charges levelled against them.

Delivering the verdict on Friday, the Magistrate ruled that the prosecution failed to prove its case against all the accused persons.

“They have all been acquitted under section 210 of the criminal procedure code. They have no case to answer. They have been set free,” said the Magistrate.

The Kamanis had been charged along with former Finance Minister David Mwiraria, who died during the trial.

The prosecution had alleged that between October 30, 2003, and April 14, 2004, the accused persons conspired with others to engage in a scheme to defraud the government of Kenya of Ksh.3.5 billion through a suppliers credit contract agreement for the modernisation of the Police Security Equipment and Accessories Project.
