DPP directs DCI to close file against former Interior CS Fred Matiang’i over insufficient evidence to sustain charges.

On Monday, March 13, the Director of Public Prosecutions dismissed all allegations against former Interior Cabinet Secretary Fred Matiang’i and his lawyer Danstan Omari.

The DCI’s evidence was deemed insufficient by the Deputy Director of Public Prosecutions, Lilian Obuo, in a statement to the media.

DCI charges against former Interior CS Matiang’i were conspiracy to commit a felony and publication of false information.

“The evidence provided did not meet the ingredients needed to prove each of the fore- mentioned offences as required by law.

“The Director of Public Prosecutions has therefore directed the Directorate of Criminal Investigations to close the inquiry file with no further police action,” the statement read in part. 

According to the statement, the DCI had submitted recommendations in an inquiry file dated March 7, 2023, that Fred Matiang’i and his advocate Danstan Omari be charged for the offences.

However, the ODPP stated that after independently reviewing statements from the witnesses and analysing the evidence provided, it did not find a reason to charge Matiang’i.

“The Director of Public Prosecutions found that the evidence provided was not sufficient to sustain the above charges against Dr Fred Okeng’o Matiang’i and his advocate Danstan Omari,” the statement added.

Charges against the former CS were brought as a result of a February 8 allegation of an alleged police incursion at his Karen residence.

However, a number of criminal justice-related organizations, including the head of the DCI, Mohamed Amid, distanced themselves from the allegations by pointing out that no officer was sent to arrest Matiang’i and announcing an investigation to look into the situation.

On Tuesday, March 7, CS Fred Matiang’i responded to the DCI’s summons in the company of his legal team, which was led by Attorney Danstan Omari.

The summon faced criticism from the legal team including Rarieda Member of Parliament Otiende Amollo who argued that the former CS had been interrogated for 15 minutes and detained for over five hours.

“It is clear that this was not a criminal investigation. This was a vendetta and witch hunt! It is also clear that the DCI was not acting of their own motion, but were awaiting instructions on what to do,” Amollo stated.
