Former Chief Justice Willy Mutunga has slammed lawyers dismissing Azimio’s Petition seeking to invalidate Ruto’s win at Supreme Court.

Ekuru Aukot, the leader of the Third Way alliance, has come under fire from retired chief justice Willy Mutunga for dismissing Azimio’s presidential petition.

In a statement on Monday, August 22, Aukot proposed that those who or groups who expose Kenyans to meaningless petitions should be penalised.

Aukot’s sentiments came after Azimio presidential candidate Raila Odinga and other Kenyans challenged the 2022 polls at the Supreme court. 

The lawyer suggested that the country should criminalise such petitions to save time. 

“Wasting the time of Kenyans on frivolous lawsuits or petitions should be criminalised,” wrote the former presidential aspirant. 

Ekuru Aukot comments did not go down well with the former Chief Justice Will Mutunga, who termed him greatly misguided. 

Mutunga added that it was pitiful for such comments to come from a former member of the Committee of Experts that gave Kenya the 2010 Constitution. 

He explained that the petition is meant to seek a remedy to a problem, and it should never be criminalised. 

“Says former Secretary of the Committee of Experts that gave us the 2010 Constitution. What a pity? Greatly misguided. A petition seeks a remedy. How can that be criminalised? Smacks of fascism,” wrote Mutunga.
