IEBC announces reallocation of special seats

The Independent Electoral and Boundaries Commission (IEBC) has announced the reallocation of vacant special seats in accordance with Article 90 of the Constitution and Section 37(1) of the Elections Act, Cap 7.

In an official statement issued on Friday, July 25, 2025, the IEBC stated that the allocation of the vacant seats is carried out based on the priority in which nominees were listed by their respective political parties, as submitted during the 2022 General Election.

“In our commitment to upholding the principles of democracy and fair representation, the Commission plays a central role in managing electoral processes guided by the constitution and relevant statutes and regulations,” the IEBC announced.

“The Commission is mandated to conduct elections based on proportional representation through the use of party lists, in accordance with Article 90 of the Constitution of Kenya and Section 37(1) of the Elections Act, Cap 7. The allocation of seats is carried out based on the priority in which nominees were listed by their respective political parties, as submitted during the 2022 General Election.

Additionally, the electoral commission added that it had reallocated one special seat in the National Assembly and nine special seats in various county assemblies after the respective speakers declared vacancies owing to the resignation or death of former members.

The Commission added that the re‑allocations had been officially published on Thursday, July 24, 2025, in a special issue of the Kenya Gazette Notice, confirming the formal release of the updated party‑list allocations as provided by law.

“In line with this mandate, the Commission has reallocated one (1) special seat in the National Assembly and nine (9) special seats in various County Assemblies, following declarations of vacancies by the respective Speakers. These vacancies arose due to the resignation or death of the former members, “IEBC stated.

“The re-allocations were officially published on Thursday, 24th July 2025, in a special issue of the Kenya Gazette (Notice No. 10083, Vol. CXXVII-159).”

Furthermore, IEBC affirmed that it remained steadfast in its commitment to upholding constitutional principles of fairness, inclusivity, and transparency throughout the electoral process.
