IEBC bars Mike Sonko from contesting for the Mombasa gubernatorial seat in the August elections.

The Independent Electoral and Boundaries Commission has barred Mike Sonko, from contesting for the Mombasa gubernatorial seat.

Wafula Chebukati, the chairperson of IEBC, stated that anyone who was removed from office for breaking Chapter Six of Kenya’s Constitution is ineligible to run for election.

Sonko was disqualified alongside Paul Karungo Thangwa, a Kiambu Senatorial candidate who was impeached by the Kiambu County Assembly after the impeachment of Kiambu Governor Ferdinand Waititu.

Chebukati said all the leaders who were impeached will be barred from taking up any elective roles in the government.

IEBC bars Mike Sonko; reasons

“The reason for disqualification was and remains that he was removed from office for abuse of public office. He was convicted by the court on December 15, 2011, and sentenced to three years imprisonment,” Chebukati explained the reason for Sonko’s disqualification.

“The three aspirants who were impeached are disqualified from contesting. A person who is removed from office on contravention of Chapter 6 of the Constitution is disqualified from holding office, elective or appointed,” Chebukati explained.

Others disqualified are Thuo Mathenge, David Mberia, Jeremiah Loromukai, and Anthony Chitavi.

Thuo Mathenge was seeking the Nyeri Governor seat on a TND ticket.

IEBC, however, cleared aspirants who are under investigation will be cleared to contest saying that they can only be barred once convicted by a court of law.

“Cases of aspirants under investigation are 11; one presidential aspirant and 10 gubernatorial aspirants. They are not disqualified by law and may contest, in keeping with the presumption of innocence until proven guilty,” Chebukati said.
