Jimi Wanjigi released on Ksh10 million bond

Businessman Jimi Wanjigi was on Tuesday, August 20 freed on a personal bond of Ksh10 million
Businessman Jimi Wanjigi was on Tuesday, August 20 released on a personal bond of Ksh10 million.
Businessman Jimi Wanjigi has been released on a personal bond of Ksh10 million after being arrested and detained at Kamukunji Police Station on Monday.
Chief Magistrate Susan Shitubi directed Wanjigi to deposit his passport in court pending a ruling on his plea-taking that will be delivered on September 12, 2024.
Wanjigi was released together with his personal assistant David Kibe.
The renowned businessman was released after his legal team comprised of Klaonzo Musyoka, Paul Muite, Willis Otieno and John Khaminwa asked the court to defer Wanjigi’s plea-taking, claiming that his rights were violated.
The defense lawyers argued that Justice Bahati Mwamute had issued an order blocking the police from arresting their client.
Wanjigi’s lawyers asked the court to postpone the plea.
Senior Counsel Paul Muite claimed that a prior court order barred the police from arresting Wanjigi.
He noted that the order also instructed the police to release Wanjigi if he had already been detained.
The lawyers also claimed that, in response to allegations of illegal firearm possession, the police acted maliciously and in contempt of court by cancelling Wanjigi’s firearm licence, which had been reinstated by the High Court.
Lawyer Wallis Otieno added that the Firearm Licencing Board revoked Wanjigi’s licence, which had been restored, in order to charge him with illegal firearm possession.
Otieno also contended before Presiding Magistrate Susan Shitubi that the charges against Wanjigi were fundamentally flawed, as the police had violated court orders by arresting him.
He also stated that Wanjigi was detained after voluntarily responding to a police summons to appear before DCI officers.

Otieno also claimed that the second accused, Kibe, was subjected to physical abuse by police, who allegedly caused pain by squeezing his genitals while in custody.
Wanjigi was arrested on Monday afternoon moments after he presented himself to the Directorate of Criminal Investigations (DCI) for grilling over his alleged funding of the anti-government protests.
He was detained at the Kamukunji Police Station before being arraigned in court on Tuesday morning.
On Monday, Dennis Itumbi pointed out that Wanjigi was arrested over following the revocation of his firearms license and not because of protests.
“Pursuant to Section 4(1) read together with Section 4(3)(b) of the Firearms Act, you are in possession of firearms without a valid/expired Firearms Certificate contrary to the law,” a letter shared by Itumbi from the Firearms Licensing Board boss Rashid Yakub read in part.
