Six judges rejected by Former President Uhuru Kenyatta an apology from the state and Ksh.23M compensation.

The six judges whose appointment was declined by former President Uhuru have filed a lawsuit in court seeking restitution and an apology from the State.

The judicial officials, who are led by Justice Aggrey Muchelule, claim that from July 22, 2019, till September last year, when they were formally appointed by President William Ruto after his inauguration, the State never provided them with explanations for why they had never been appointed.

The six contend that they were subjected to public humiliation and now demand that the President’s office provide a formal apology and remove any doubts about their suitability for service.

“We suffered public humiliation because of the insinuations created by Uhuru Kenyatta and other public officials to the effect that we were collectively persons not fit to hold the offices of judges in Kenya,” they argue in court documents.

The Court of Appeal judges; Korir Weldon Kipyegon, Muchelule Aggrey Otsyula, Odunga George Vincent, and Prof. Joel Mwaura Ngugi, are seeking Ksh.3.9 million each as compensation from the State. 

On the other hand, the two environment court judges; Makori Evans Kiago and Cheruiyot Omange Judith Elizabeth, want Ksh.3.7 million each.

 This cumulatively totals Ksh.23 million.

Former President Uhuru Kenyatta had stated that he turned down their nominations “for failing to meet the required threshold”.

Despite several court orders, a case to have him impeached and another to bypass him and have Chief Justice Martha Koome swear the six, the former President maintained that he would not be coerced to make the appointments.
