Former Chief Justice David Maraga has warned President William Ruto that the International Criminal Court (ICC) could make a comeback to the country over the recent politically instigated demonstrations in the country.

In a press briefing on Monday, July 7, the former CJ claimed that the reckless statements and orders the president is dispensing, especially during a time when the political tension is culminating, have attracted the attention of the international community, particularly the ICC.

According to Maraga, if the ICC kickstarts a probe, it will have sufficient evidence and witnesses to convict the president and other top leaders.

“I will not be surprised to see that the ICC is back, because the last time they were after you, the witnesses were not there. Those people are not fools, and this time round they can do their investigations very well and come back,” Maraga said.

“What is being projected in international news shows that the whole world is shocked by what is happening in Kenya. We are not in a state of war, but we are having 60 people dead in less than a month, and reckless statements being made, especially by the president, that is not normal,” he added.

According to Maraga, who recently declared his intention to run against Ruto in the upcoming 2027 general election, the president’s failure to fulfil his pre-2022 election promises will make it impossible for him to regain the people’s trust, even through dialogue.

The warning by Maraga comes just two days after former Deputy President Rigathi Gachagua revealed that he has assembled a team to compile evidence against President William Ruto in a bid to prepare a case against him in the ICC.

According to Gachagua, who was speaking to Kenyans in the United States on Friday, July 11, the new case will be added to the President’s ICC file over the 2007 post-election violence, which was not concluded but only put on hold.

Gachagua claimed that the killings happening in Kenya, allegedly being conducted by security agencies, are admissible before the ICC.

According to Gachagua, the team is keen to ensure that everything is in order to prevent any loopholes that may block the case from being successful.

“I want to confirm that I have put up a team that is documenting all the atrocities, the killings, displacements, disappearances, and abductions taking place in Kenya,” Gachagua said.

“We have a team that is putting evidence together to take William Ruto to the ICC at The Hague,” he added.
