Senior Counsel Martha Karua has revealed that she was not independently representing blogger Ndiang’ui Kinyagia but acted jointly with the Law Society of Kenya (LSK).

However, when the LSK requested to recuse themselves from the case, she had no choice but to follow suit and withdraw from the case.

The People’s Liberation Party(PLP) leader was responding to concerns that the blogger had been abandoned after he was accused of self-abduction.

“But now, even the LSK and Martha Karua are distancing themselves from his case. As the spotlight dims, he’s been left to face the consequences alone, abandoned by the very voices that once rallied behind the cry, ‘Free Ndiangui’,” the post read in part.

In a quick rejoinder, Karua maintained that Ndiang’ui deserves representation, even if not done by her.

“I was appearing alongside LSK, and when LSK seeks to withdraw, I lose the locus; otherwise, I do think he deserves representation,” Karua wrote.

According to Karua, after LSK withdrew from the case, she lost the legal standing or the right to appear before the court in that specific matter, since she was relying on LSK’s capacity.

The senior counsel went further to reveal that she does not support how the events surrounding the search for Ndiang’ui unfolded, including the DCI breaking into the blogger’s home and causing tension.

“Do not forget, the police broke into his house without a warrant, and reigned terror on an entire neighbourhood. I do not judge him,” Karua noted.

Appearing before the Milimani Law Courts on Thursday, July 24, Kinyagia, who is a software engineer, revealed to the court that he currently only has two lawyers, Kibe Mungai and Wahome Thuku.

LSK had initially backed a habeas corpus petition, claiming Kinyagia was abducted by state agents under suspicious circumstances.

However, upon investigations, it was revealed that he had intentionally gone into hiding, undermining the credibility of the petition and triggering a swift legal about-face.

In fresh court filings, LSK’s legal team, VR Advocates & Partners LLP, formally applied to withdraw from the case, citing inconsistencies in Kinyagia’s narrative and a breakdown in trust between client and counsel.
