More woes for Matiang'i as Itumbi writes to EACC over Ruaraka land saga

Matiang’i a man under siege again as Dennis Itumbi writes to EACC and DPP to have an investigation on the Ruaraka land saga concluded.

Digital strategist Dennis Itumbi has urged the Ethics and Anti-Corruption Commission (EACC) to wrap up its inquiries into the state’s erroneous 2017 purchase of public land in Nairobi.

Ruaraka High School and Drive Inn Primary School are located on a 13-acre parcel of land that was illegally acquired, according to Itumbi, who also accuses former Interior Cabinet Secretary Dr. Fred Matiang’i of being the brains behind the scheme.

Itumbi contends that the land previously belonged to the government and that Dr. Matiang’i’s Ministry of Education’s forced acquisition of it resulted in an illegal loss of Ksh 1.5 billion.

Itumbi has written to the EACC and the Office of the Director of Public Prosecutions (DPP) to request that they if found guilty, bring charges against those involved in the saga.

“We demand, which we also hereby do, that within the

next coming seven (7) days you inform us on the progress your Commission has made in its additional investigations implicating the above-named individual and the other culprits,” the letter reads in part.

According to Itumbi’s communication. this is the second time he is writing to the graft mitigation agency and the state prosecutor over the involvement of Matiang’i in the Ruaraka Land saga.

“Our client informs us that by your letter dated 8th October 2020, you responded to him and stated that you would respond to the issues raised in “due course”,” he says.

“In his response by a letter dated 14th October 2020, he sought clarification on how many days the Commission had in mind when using that phrase. We attach the said letters for ease of reference,”

He expressed disappointment that, three years after the DPP referred the file to the EACC for additional investigations, nothing had been done despite the agencies’ promises to look into and prosecute the case.

Itumbi highlighted the Anti-Corruption and Economic Crimes Act in his letter, which requires the EACC to look into and make recommendations to the DPP on any instances of corruption or ethical violations.

He criticized the agencies for their reluctance to conclude investigations and prosecute those involved, suggesting that the loss of Ksh 1.5 billion was “pocket change” to the wealthy taxpayers of Kenya.
