Oscar Sudi makes incriminating statement  admitting that he didn’t go to school a year after acquittal on fake certificates.

Kapseret MP Oscar Sudi has made a bold admission on his academic credentials a year after he was acquitted in a case concerning the legitimacy of his Kenya Certificate of Secondary Education (KCSE) certificate. 

Speaking on Sunday, April 14, the MP appeared to admit that he never attended school, raising eyebrows about the forgery case.

“You have heard people say that I did not go to school; do you think those people are lying? Have you ever heard me claim anywhere that I went to school? But when you come to my constituency, I have worked because of my experience,” he said.

Sudi went further to draw a contrast between himself and other leaders including Kikuyu MP Kimani Ichung’wah who attended Alliance High School.

“MP Kimani Ichung’wah is among people who were lucky and got a chance to go to school, but some of us didn’t go to school,” he added.

In 2015, the Ethics and Anti-Corruption Commission (EACC) initiated an investigation into Sudi’s academic qualifications following allegations that he had submitted forged documents to the Independent Electoral and Boundaries Commission (IEBC) during his 2013 parliamentary bid.  

The EACC’s findings suggested that Sudi’s KCSE certificate and a diploma in Business Management from the Kenya Institute of Management (KIM) were falsified.

A year later, in 2016, the Director of Public Prosecutions (DPP) charged Sudi with multiple offenses, including forgery, providing false information, and making a false statutory declaration. 

The MP attempted to halt the prosecution, arguing that his rights were violated, but the High Court dismissed his petition in 2018.

Sudi proceeded to the Court of Appeal to challenge the ruling but also lost the bid, allowing the trial to proceed.

“In this case, what the applicant seeks to be stayed are the criminal proceedings instituted and pending in the chief magistrate’s court. 

“While it is not lost to us that the applicant had sought to challenge the constitutionality of the said criminal proceedings in the constitutional petition filed in the High Court, the said criminal proceedings are not the subject of the appeal before the appeals court,” a three-judge bench comprising of William Ouko, Wanjiru Karanja and Asike Makhandia ruled.

During the trial, the prosecution called 14 witnesses, including officials from KIM and Highway Secondary School. 

Testimonies revealed that Sudi’s name did not appear in the records of students who sat for the KCSE at Highway Secondary School in 2006, and the diploma certificate he presented had an admission number belonging to a different individual.

Additionally, the investigating officer testified that the certificates were forged and that Sudi had provided false documents during their meeting at a hotel in Nairobi.

However, come June 7, 2024, Chief Magistrate Felix Kombo acquitted Sudi of all charges, ruling that the prosecution failed to prove its case beyond a reasonable doubt.

Kombo also mentioned that some of the evidence provided by the prosecution was improperly obtained.
