On Friday, May 5, the prosecution team in Paul Mackenzie’s case highlighted concerns on a plot by the pastor, his wife, and followers to start a church while they were in custody. 

Jami Yamina, the chief prosecutor, hinted during her testimony in court that the suspects had asked to be held at one police station.

It was discovered that Mackenzie and his wife, Rhoda Maweu, as well as 16 other suspects, had asked to be imprisoned at the Malindi Police Station together.

The request prompted the Shanzu Principal Magistrate Yusuf Shikanda to raise concerns.

Yamina also added that holding the suspected in one cell exposed others to the danger of being radicalized by the group.

“What is the danger of giving them a list of where each particular respondent will be detained?” the magistrate posed.

“Although they want Malindi Police Station all of them at once, I am apprehensive that we do not want them to open a church in a station.

“We must ensure that we distribute them appropriately,” the prosecutor responded.

Consequently, the magistrate ruled that the suspects be held in three different police stations for five more days before a ruling on their further detention is made on May 10.

Malindi, Marerreni, and Mbwatamu Police Stations were selected as the preferred jails for the suspects.

Police seek to detain the 18 suspects for 90 days to complete investigations into the alleged cult run by the controversial pastor at Shakahola Forest.

DNA tests and other body identification techniques will be applied, with hundreds of Kenyans flocking to the Coast in search of their lost kin. 

The prosecution added that it was unsafe for the suspects to be released as the police could not guarantee their protection. 

They were also accused of being able to tamper with witnesses and evidence.
