Supreme Court Pre-Trial Conference on the presidential petition challenging IEBC election results set for tomorrow, 11 am
The Apex Court on Monday, August 29, announced Tuesday at 11 a.m. as the scheduled time for the pre-trial conference on the presidential petitions contesting the election of William Ruto as president-elect.
After the preliminary hearing, the petition will be heard, and the decision will be made on September 5.
In a notice issued by Supreme Court Registrar, Letizia Wachira, the Judiciary noted that the conference would begin at 11 am on Tuesday, August 30, at the Milimani Law Courts Ceremonial Hall.
“Take notice that the pre-trial conference has been scheduled for 30th August 2022, at the Milimani Law Courts ceremonial hall at 1100hrs,” a notice from the judiciary stated.
The seven-Judge bench led by Chief Justice Martha Koome will call upon the litigants of the nine petitioners to establish issues that they agree upon and those that are disputed.
The Supreme Court judges will then decide whether or not to consolidate the nine petitions based on how the court outlines the concerns.
Following that, the Apex Court will issue instructions to ensure that parties attend pre-trial conferences. This includes deciding how many advocates each party will be permitted to use.
The bench can also decide whether or not to accept requests from parties who are interested in joining the case as amicus curiae and, if accepted, how much of a contribution they are authorized to make.
The Supreme Court Chief Justice will then allocate time to each party to address the court during the hearing, and give directions on where the legal teams representing the petitioners and respondents will be seated.
Nine presidential petitions were lodged at the Supreme Court on Monday with eight of them seeking to overturn President-Elect William Ruto’s victory.
The petition will be heard by CJ Koome and Justices Philomena Mwilu (Deputy Chief Justice), Smokin Wanjala, Njoki Ndungu, Isaac Lenaola, Mohamed Ibrahim, and William Ouko.
According to constitutional guidelines, the Supreme Court is expected to give a ruling on or before Monday, September 5, 2022.
