  • There’s no president-elect, Raila says as rejects August presidential results

    Raila rejects presidential results announced by IEBC chair Wafula Chebukati terming the results Null and Void. 

    Azimio presidential candidate, Raila Odinga, has rejected the IEBC presidential results that declared William Samoei Ruto as the president-elect.

    Addressing the press at the Kenyatta International Convention Centre (KICC) on Tuesday, August 16, Raila claimed that the Independent Electoral and Boundaries Commission (IEBC) chairperson, Wafula Chebukati, contravened the law.

    Raila claimed that the IEBC did not have a quorum when it announced the result of the presidential election.

    He accused IEBC chair Wafula Chebukati of denying other commissioners access to the results before making them public.

    Raila rejected the presidential results stating that Iebc chairperson Wafula Chebukati did not follow the law and failed to follow the constitution. 

    He further went ahead to term the results Null and Void, calling on the courts to annul such an election.

    “The figures announced by Mr. Chebukati are null and void and must be quashed by a court of law. In our view, there is neither a legally and validly declared winner nor a President-Elect.”

    “We were shocked to learn that Mr. Chebukati decide alone to name the winner of the 2022 election. He denied all the commissioners access to the results,” Raila stated.

    Raila Odinga who was accompanied by his running mate Martha Karua, Kalonzo Musyoka among other leaders called on their supporters to remain calm stating that their legal team were handling the matter.

    “I want to commend our supporters for keeping calm and keeping peace and urge them to continue doing so. Let no one take the law into their own hands. Justice will prevail,” he stated.

    Raila Odinga, unsuccessfully contested the presidency four times starting in 1997, then in 2007, 2013, and 2017 with his fifth stab at the presidency in just concluded August 9, 2022, polls.

  • IEBC Vice Chair Juliana Cherera reveals why they disowned presidential results

    IEBC Vice Chair Juliana Cherera has revealed why they disowned the presidential results announced by Wafula Chebukati.

    Juliana Cherera, the Independent Electoral and Boundaries Commission (IEBC) have come out to explain why she and three commissioners disowned results that declared Deputy President William Ruto as the president-elect.

    On Wednesday, August 16, Cherera stated that IEBC Chairperson Wafula Chebukati gave them a wrong aggregation of the results noting that they never had time to verify the results.

    She argued that the calculations that Chebukati gave them a total of 100.01 percent.

    The IEBC Vice Chair stated that they declined to acknowledge the results because the accuracy of the source of the figures tallied was not comprehensive.

    She maintained that the results did not indicate the total number of registered voters, voters cast and rejected votes in this regard and they lacked a critical ingredient naming a total number of total votes cast.

    “We concluded that the process that went into the generation of Form 34 C used to declare Ruto was opaque. Guided by the authority of the Maina Kiai case as upheld by the Supreme Court in 2017, we state categorically that the results of the elections declared by Chebukati belong to himself and do not represent that of IEBC,” she added.

    IEBC Vice Chair Juliana Cherera added that tallying was not known to the commissioners as it was being done by the technical staff and Chebukati did not explain to them the outcome despite questions being raised.

    “By the time Wafula Chebukati was declaring the results, verification from certain constituencies had not been announced,” stated Cherera.

    Commissioner Justus Wanderi stated that the commissioners did not do the tallying and he further explained that the data was compiled by the technical team and submitted to the commissioners at 4:30 pm.

  • Ruto to hold Kenya Kwanza leaders inaugural meeting

    Ruto to hold Kenya Kwanza leaders inaugural meeting on Wednesday at Karen residence just a day after declared president-elect.

    Wednesday will mark the first gathering of the Kenya Kwanza Alliance, which will include senators, representatives for women, governors, and members of the National Assembly who were just elected in the general election.

    The meeting will take place in the Deputy President’s Residence in Karen, according to Veronica Maina, secretary general of the United Democratic Alliance (UDA), in a statement to newsrooms.

    “The President-Elect His Excellency Dr. William Ruto together with Deputy President-Elect, His Excellency Rigathi Gachagua hereby invite the following categories of newly elected leaders to the First Caucus of Leaders elected to serve at the Senate, the National Assembly, and all elected Governors. This Caucus will be convened at the Deputy President’s residence on Wednesday 17th August 2022 at 9:00 AM,” Maina stated.

    The meeting comes a day after the Independent Electoral and Boundaries Commission (IEBC) declared Ruto as the President-Elect.

    William Ruto is set to control the Senate after bagging a majority of the seats across the country in the just concluded polls.

     24 senators were elected under Kenya Kwanza compared to 23 of Azimio La Umoja One Kenya under the stewardship of Raila Odinga.

    Azimio la Umjoa has a majority in the National Assembly with 162 members compared to Kenya Kwanza which has 159 members.

    Raila’s Ex-Spokesman Salim Lone speaks on IEBC’s declaration of Ruto as president-elect with Raila set to address the nation at 2 pm at KICC.

    Salim Lone said that the presidential results announced by the Independent Electoral and Boundaries Commission chair Wafula Chebukati were unacceptable.

    In an interview with the BBC on Monday, August 15, Lone said that after the declaration, he had a lengthy conversation with his former boss. The outcomes, in Raila’s view, represented a “rape of democracy.”

    Lone claimed that the flag-bearer was unhappy with the outcomes and that, after assiduously running in four general elections, the fifth attempt was the best.

    “I just had a long conversation with Raila Odinga, his thoughts were the result was like rape of democracy. So, he does not find it acceptable at all,” stated Lone.

    The veteran journalist added that from the lengthy conversation with Raila, it was still unclear whether he will take any legal action against the presidential election results.

    In addition, Raila through his Ex-Spokesman Salim Lone stated that the results announced by the electoral body lacked credibility after four of the seven commissioners said they did not agree with the results.

    Meanwhile, Azimio presidential candidate Raila Odinga is expected to address the nation at 2 pm.

    His press secretary Dennis Onsarigo said on Tuesday, 16 after IEBC declared William Ruto as president-elect.

    “Raila to address the Nation at KICC, Azimio Media Center,” his press secretary Dennis Onsarigo said.

    This is the first time he will speak after IEBC declaration.

    The Independent Electoral and Boundaries Commission has already gazetted William Ruto as the President-elect of the Republic of Kenya.

    IEBC gazettes William Ruto as President-Elect of the republic of Kenya after the 2022 general elections held on Tuesday, August.

    The Independent Electoral and Boundaries Commission (IEBC) has officially gazetted Deputy President William Ruto as the president-elect.

    In a gazette notice published on August 16, IEBC chair Wafula Chebuakati reaffirmed that Ruto had been legitimately chosen in accordance with the conditions and guidelines of the Kenyan Constitution of 2010.

    Chebukati declared that after being sworn in, Ruto and his deputy-elect, Rigathi Gachagua, will have the authority to govern the nation.

    “William Ruto and Rigathi Gachagua have been duly elected as the President and Deputy President, respectively, of the Republic of Kenya having complied with the provisions of Article 138 (4) of the Constitution, during the General Election held on Tuesday, August 9, 2022,” Chebulati stated.

    This follows the events of Monday, where Ruto was announced as the winner of the hotly contested August 9, General election.

    Ruto garnered 7,176,141 votes, 50.4% against his close rival Raila Odinga who received 6,942,930 votes, 48.85 percent of the vote.

  • Do four IEBC commissioners disowning Presidential results affect Ruto’s win

    IEBC commissioners disowned the Presidential results announced by Wafula Chebukati declaring William Ruto as President-Elect.

    And a section of lawyers have disagreed on whether Wafula Chebukati, the chairman of the Independent Electoral and Boundaries Commission (IEBC), erred in designating William Ruto as the winner of the election without the support of the other four commissioners.

    This comes after four of the seven commissioners of the IEBC addressed a press conference from Serena and disowned the results due to what they described as the opaqueness of the process during the final phase.

    Minutes before the chairman of the electoral commission Wafula Chebukati announced that Ruto had won, his deputy Juliana Cherera had told media at a separate location that she and three other commissioners disowned the results.

    The four IEBC commissioners alleged that the results were arrived at in an opaque manner without giving further details. 

    “We are not able to take ownership of the results that will be announced, because of the opaque nature of this last phase of the general election,” she said.

    The electoral commission has seven commissioners.

    IEBC Chairman Wafula Chebukati declared Deputy President William Ruto the winner of a tight presidential race on Monday.

    Chebukati said Ruto had won 50.49% of the vote, against Odinga’s 48.5%.

    Do four IEBC commissioners walk-out affect Ruto’s win

    Article 138 of The Kenyan Constitution says the Presidential votes shall be “tallied & verified” by the Commission & announced by the Chairman.

    It is the duty of the National returning officer to announce the results of the presidential results and the winner.

    Article 138(10) of the Constitution provides that the Chairperson of IEBC shall declare the results of the presidential election. 

    The law does not demand quorum. However, the walk-out by four Commissioners taints the process.

    Several lawyers in the country have differed on whether IEBC Chairman Wafula Chebukati erred in declaring William Ruto as President-Elect without the concurrence of four other commissioners.

    Makau Mutua who is also the Azimio la Umoja coalition presidential campaign spokesman stated that the results declared by Chebukati were of no effect because it was not backed by a majority of the Commissioners.

     “Any results IEBC chair Wafula Chebukati announces are invalid because he had no quorum of commissioners to hold a plenary and make such a weighty decision. The ongoing process at Bomas is now illegal.”

    However, another Senior Counsel Ahmednassir Abdullahi defended Chebukati not that the law recognizes the IEBC Chairman as the sole returning officer of the Presidential Election.

    “A Presidential election has a single Returning Officer…THE CHAIRMAN…other Commissioners have no role in a presidential election,” he said in a post on his Twitter account.

    Now it will be a matter to be determined by the Supreme Court of Kenya if a case is filed within seven days challenging the determination of the IEBC.

    After the case is filed, the Supreme Court has 14 days to hear and determine the petition. The court’s decision on whether to uphold or nullify the election would be final.

  • Foreign leaders congratulate President-elect Ruto

    Foreign leaders congratulate President-elect William Ruto after being announced as the winner of the presidential election.

    Deputy President William Ruto was declared President-Elect by the IEBC after sailing past the ‘50 percent plus one’ constitutional threshold that requires a winner in a presidential election to garner 50 percent of votes cast.

    Ruto garnered 7,176,141 (50.49 percent) votes beating his closest challenger, Azimio’s Raila Odinga, who managed 6,942,930 votes (48.85 percent).

    After the IEBC announcement, several foreign leaders have already congratulated William Ruto after winning the August presidential election.

    Foreign leaders congratulate Ruto

    Zimbabwe President Emmerson Mnangagwa is among foreign leaders who have congratulated President-elect William Ruto.

    Taking to Twitter on Monday, Mnangagwa expressed confidence that Ruto will be a reputable leader.

    “Congratulations to William Ruto on his election as the next President of Kenya,” he said in a tweet.

    “I have no doubt he will serve his country, his people, and our continent with distinction,” Mnangagwa added.

    Tanzanian president Samia Suluhu congratulated the people of Kenya on their peaceful general election and the subsequent announcement of WilliamsRuto as President-elect.

    “I congratulate the people of Kenya on their peaceful general election and the subsequent announcement of Dr @WilliamsRuto as President-elect. We look forward to continuing working together with our brothers and sisters in Kenya to strengthen our historically close ties. Tuko pamoja”

    South Africa President Cyril Ramaphosa also offered his congratulations to President-elect William Ruto on his win.

    “I offer my warm congratulations to President-Elect @WilliamSRuto

     of the Republic of Kenya. A prosperous and united Kenya is an important prerequisite for and contributor to a prosperous and peaceful continent. We look forward to working with you in pursuit of #TheAfricaWeWant”

    President Muhammadu Buhari of Nigeria in a statement issued on Monday by his spokesman, Femi Adesina, lauded the people of Kenya for the peaceful and transparent outcome of the elections.

    President Buhari said Nigeria valued Kenya as a strategic partner in the fight against terrorism and violent extremism, buoyed by a long history of friendship, economic and trade ties, and effective collaboration through international organizations such as the African Union, the United Nations, and the Commonwealth.

    New Somalia President Hassan Mohamud — through Villa Somalia, the Office of the President — congratulated Ruto in a tweet, saying, he looks forward to working with him towards stronger bilateral relations and closer cooperation.

    Ethiopian Prime Minister Abiy Ahmed congratulated Ruto on his election as the fifth Kenyan president.

    “My congratulations to William Ruto, on your election as the President of the Republic of Kenya. I wish you luck in your endeavors ahead,” he said.

    Ahmed added, “We look forward to working closely with you on common bilateral and regional interests.”

  • Missing IEBC official found dead

    Missing IEBC official for the Embakasi East constituency has been found dead in Loitoktok, Kajiado South sub-county.

    Daniel Mbolu Musyoka, the missing returning officer for Embakasi East for the Independent Electoral and Boundaries Commission (IEBC), has been discovered dead in Kajiado.

    Police officials from Loitoktok, Kajiado South sub-county, received a report of a middle-aged man’s body in the bush on Monday evening.

    The body was recognized by his sisters Mary Mwikali and Ann Mboya at the Loitokitok sub-county mortuary, according to Loitoktok police chief Kipruto Ruto.

    “His two sisters identified the body lying at Loitoktok sub-county hospital last night. We are waiting for communication from police headquarters either to ferry the body to the city mortuary or to remain here,” Mr. Ruto said.

    The missing IEBC official, Mr. Musyoka, 53, was serving as returning officer at Embakasi East constituency in Nairobi county.

    Mr. Ruto claims that herders at the foot of Mount Kilimanjaro’s Kilombero forest found the body of a middle-aged man early on Monday.

    The gruesome find was made by herders. The body was reportedly dumped into the valley of a dry seasonal river.

    The location is infamous for being where murder victims are dumped.

    Despite the fact that the man’s clothes, a tracksuit, and a Maasai shuka, were discovered at the valley’s edge, the police chief said the body was naked.

    The victim’s body bore obvious evidence of struggle and torture, he said.

    No identification documents were recovered near the man’s body.

    “It is evident that the victim was killed elsewhere and the body dumped in the valley. The body has scars indicating torture before the death. He possibly died a painful death,” Mr Ruto said.

    The body was moved to Loitokitok Sub-County Hospital mortuary awaiting identification after police officers collected fingerprints.

    “We are reaching out to families that have lost their loved ones to come for identification as we wait for fingerprints processing,” said the police boss who added that they could not speculate on the identity of the dead man.

    IEBC commissioners injured with others missing as fracas broke out during the announcement of the presidential election results.

    Independent Electoral and Boundaries Commission chairperson Wafula Chebukati says that two commissioners and the CEO, Marjan Hussein, were injured in the Monday, August 15 scuffle at the Bomas of Kenya. 

    He added that two other staff are missing and others were arrested arbitrarily. 

    Chebukati stated that members of his staff faced a lot of intimidation during the electoral process but they remained calm during the process.

    Wafula made the statements moments before declaring Deputy President William Ruto as the President-Elect of the republic of Kenya.

    Additionally, he maintained that the electoral process was democratic insisting that he ensured that the will of the people was respected during the elections.

    “This will be my last election to preside and those who will come later will find an independent commission.

    “The people of Kenya exercised their democratic right and this is the will of the people,” Chebukati stated. 

    Chebukati had earlier been accompanied by Commissioner Prof Abdi Guliye and Boya Molu before the fracas broke out.

    Chebukati had to be protected by the police as some of the politicians made was to the dias prior to the much-anticipated announcement.

    Four IEBC commissioners disown the presidential results of the general election citing the opaqueness of the process.

    Four IEBC commissioners have disputed the presidential elections set to be announced by the IEBC chairman Wafula Chebukati.

    The four led by commissioner Juliana Cherera said they cannot take ownership of the results because of the opaque nature they have been handled. 

    Juliana Cherera together with Francis Wanderi, Justus Nyangaya, and Irene Masit, refused to take ownership and sign the results owing to the opaque nature of the final process of verification of the results.

    “We have done the 2022 general election in the most efficient manner. We have ensured that all the challenges have been contained,” commissioner Juliana Cherera said during a hastily arranged press briefing at Serena Hotel.

    At Bomas, IEBC Wafula Chebukati’s efforts to announce the final presidential elections results was marred by violence after a section of leaders stormed the podium.

    The IEBC chairperson was whisked away faster by law enforcement officers at Bomas.

    This come after Azimio la Umoja Chief Agent Saitabao Kanchori claimed that the IEBC system had been compromised.

    Speaking at Bomas of Kenya, Kanchori added that Azimio’s claims were backed by intelligence information that unknown persons had infiltrated the system. 

    “We have intelligence reports that the IEBC system was penetrated and hacked and that some of the IEBC officials had actually committed intellectual offences and some of them ought to be arrested,” he stated.

    “We were not in any position to ask our party leader to come before we actually verify results, which we have not done,” Kanchory added.
