Three men sentenced to life in prison for stealing a phone, a memory card and shoes

Three men have been sentenced to life in prison by a court sitting in Ngong following their conviction for violent robbery.

According to a statement released by the Office of the Director of Public Prosecutions (ODPP) on Friday, September 26, the trio – Brian Kutitila Wanyama, Japhnae Wanyonyi Mukalama, and Thomas Wakoli Malava – were found guilty of robbery with violence, after prosecutors presented a watertight case that left no room for doubt.

The court heard that on December 18, 2021, at Kibiku in Kajiado West, the accused violently robbed Andrew Muthure Wairia of his Huawei Y9 mobile phone worth Ksh 24,990, a memory card valued at Ksh 3,995, and a pair of Reebok shoes worth Ksh 4,000.

The attackers also transferred Ksh 3,970 from the victim’s mobile money account to a number registered in Wanyama’s name.

Before fleeing the scene, the trio inflicted violence on Mr. Wairia, leaving him with injuries.

The court ruled that the prosecution had proved all elements of robbery with violence beyond a reasonable doubt, leading to life imprisonment sentences for all three men.

In addition to the central conviction, Brian Kutitila Wanyama was found guilty of willfully resisting arrest on December 29, 2021, in Bulbul, Kajiado North. For this separate offence, he received an additional two-year jail term.

The DPP also secured a second conviction against Thomas Wakoli Malava in a different robbery case. The prosecution demonstrated that on September 5, 2021, at Oloolua in Kajiado North, Malava, together with accomplices, violently robbed Patrick Nyaga Kariuki of valuables, including a smart TV worth Ksh 95,000, a Honda concrete vibrator worth Ksh 36,000, mobile phones valued at Ksh 44,000, and Ksh 50,000 in cash.

The total value of stolen property amounted to Ksh 227,000, with the victim also being subjected to violence during the ordeal.

For this second offence, Malava was handed another life sentence.

In another case of robbery with violence, the ODPP on September 11 secured convictions as two men were handed 10-year sentences for violent robbery in Mombasa.

A Mombasa court sentenced Mnyika Mwadimi Kasidi, 30, and Bora Baraza, 20, each to 10 years in jail after finding them guilty of robbery with violence contrary to Section 295 as read with Section 296(2) of the Penal Code.

The accused were convicted of violently robbing Chengo Maluki Kidinya on June 19, 2023, at about 7:30 pm at Nyumba ya Meli area in Likoni Sub-county, Mombasa County.

The court heard that the two, jointly with others not before the court, robbed the complainant of a Tecno L8 mobile phone worth Ksh 5,600 and cash amounting to Ksh 1,500, using actual violence against him immediately before the robbery.
