Okiya Omtatah calls out President Ruto as he files another petition to stop the implementation of new Affordable Housing Act 2024.

Busia senator Okiya Omtatah has moved to court alongside other petitioners to stop the implementation of the Housing Levy. 

The senator argued that there is no clear legal framework to connect or collect the levies from those in the informal sector. 

Omtatah lodged the petition just after President Ruto signed the Affordable Housing Bill into law. 

Alongside Blair Ngima, Benson Odiwuor and Karanja Matindi, they argued that MPs failed to explain how the government would tax those not in formal employment, adding that the Act remains discriminatory. 

“Are you going to install cameras on motorbikes to monitor how many people are being carried so that they can report like you do stamps in a factory? So it is it’s practically impossible. Will they be paying the 3% which the employer and the employee pay in this particular case which is 1.5% each or will they just be paying 1.5%,” posed Omtatah.

The lawmaker further argued that the Affordable Housing Act violates the use of public land where the units are built on public land and then allocated to private citizens without involving the National Land Commission. 

Omtatah likened the programme to a scheme meant to steal money and land from unsuspecting Kenyans. 

“You can not take my money to build a house for another person. If the fund has to survive, let it be voluntary, and this is a ponzi scheme to steal from Kenyans and to steal land. It’s totally unconstitutional. How will you as an individual buy a house, built by public funds on public land? And the private developer take the money,” he added. 

Nakuru-based surgeon Magare Gikenyi also sought similar orders from the courts, arguing that the law was introducing communist ideas in Kenya.
