Attempts to register THREE rival parties resembling ODM declined

Registrar of Political Parties declines the registration of three political parties whose names resemble that of the Orange Democratic Movement (ODM).

Ann Nderitu noted that the application for the new parties did not meet the standards for the registration of a new political organization in a letter to ODM Party Secretary General Edwin Sifuna.

On March 24, 2023, Sifuna and John Mbadi, the chairman of the ODM Party, complained to the ORPP, claiming that the former Kisumu CEC was inciting their political wing.

Thomas Ondijo, a former member of the Kisumu Chief Executive Committee, submitted an application to register ODM Asili, ODM Mpya, and ODM Kamili as political parties.

However, Nderitu also let Owiti know that he did not fulfill Section 8 of the Political Parties Act’s requirements.

“The application was reviewed in line with the Constitution and the Political Parties Act, 2011. This Office subsequently declined the application for reservation of the proposed names because they did not meet the requirements of Section 8 of the PPA,” Nderitu stated. 

Section 8 (b), (c) of the Political Parties Act bars anyone from registering a political party whose abbreviation is similar to an existing political party.

The former Kisumu Executive Executive Committee Member wrote to ORPP in March 2023, requesting name reservations for the three suggested political outfits. 

The Registrar of Political Parties noted that her office will therefore not reserve the names of ODM Asili, ODM Mpya, and ODM Kamili as part of the registration process.

“Reference to your letter received on 23rd March 2023 objecting to the application for the reservation of name received in this office on 13th March 2023,” Nderitu stated. 

ODM is the largest political party in Kenya born out of a protracted struggle for reforms in Kenya. 

ODM Party was born out of the NO (Orange) team that spearheaded the defeat of the retrogressive draft constitution in November 2005 with a view to restarting the constitution-making process.

The Orange victory at the referendum transformed the movement into a major political party, the Orange Democratic Movement (ODM) which Raila Odinga and current Prime Cabinet Secretary Musalia Mudavadi captained.
