Terrorism charges against Former Nairobi Governor Mike Sonko after an application by the Director of Public Prosecutions (DPP).

Former Nairobi Governor Mike Sonko can now breathe a sigh of relief after the Kahawa West Law Courts approved an application by the Director of Public Prosecutions (DPP) to drop terror charges against him and two other accused persons.

In a ruling on Wednesday, Kahawa Law Courts principal magistrate Daniel Kiage noted that he had considered the application by the DPP as he ordered the withdrawal of the matter.

“I have considered the application by the prosecution and I hereby mark the matter as withdrawn under section 87A of the CPC,” he ruled.

The former county boss had been arraigned in February 2021 alongside Clifford Ochieng Ouko and Benjamin Onyango Odhiambo over the terrorism charges.

In the case, Sonko was charged with being in possession of property intended for use in a terrorist act, which is contrary to Section 6 of the Prevention of Terrorism Act, 2012.

He was also charged with recruiting people to commit a terrorist act.

Ouko was charged with possessing a NATO military combat short, a Super Sick military combat shirt, and a pair of military desert camouflage uniforms intended for use in a terrorist act.

Sonko’s co-accused, Odhiambo, was charged with possessing a military camouflage jacket intended for the commission or facilitation of a terrorist act.

The ex-county boss was released on a Sh500,000 cash bail, while the other two co-accused were released on a Sh200,000 cash bail each.
