DPP withdraws Ruto fake assassination letter case against Dennis Itumbi citing a lack of enough evidence to prosecute the matter.

The Office of the Director of Public Prosecutions (ODPP) has dropped a prosecution in which Dennis Itumbi, the former State House digital strategist and chief administrative officer of ICT, was accused of faking a letter suggesting a plot to assassinate William Ruto in 2019.

The ODPP withdrew the case, claiming that there was insufficient evidence to proceed with the case and that the prosecution of Itumbi and Samuel Gateri was unconstitutional.

In acquitting Itumbi and Gateri, the court termed the whole process of prosecuting the two as a violation of the constitution.

Itumbi was charged with three counts in the case, including fabricating a document, publishing a false statement, and reprogramming his phone. He disputed every accusation.

The letter Itumbi was accused of forging claimed that a group of high-ranking government officials in former President Uhuru Kenyatta’s government held a meeting at La Mada Hotel, off Thika Road in Nairobi to plan the alleged assassination of Ruto.

Itumbi would later be arrested and charged over the said letter which was found to have been shared in a WhatsApp Group dubbed Tanga Tanga movement.

This comes after Milimani chief magistrate Susan Shitubi on Friday allowed the application by the DPP to withdraw the case.

Itumbi had on Wednesday accused the prosecution of delaying the case.

He told chief magistrate Shitubi that the tactic by the state to delay his case on allegations that there was no police file in court was an infringement of his rights.

Through his lawyer, Itumbi opposed the application to adjourn the case saying having no police file in court is not sufficient enough to warrant an adjournment.
