Impeached leaders to vie for elective posts after 10 years if the proposal goes through

Impeached leaders will have to wait for 10 years to vie for elective posts if the proposal by IEBC goes through.

Wafula Chebukati, the chairman of the Independent Electoral and Boundaries Commission (IEBC), is now seeking to salvage the political careers of impeached leaders, including as former Nairobi governor Mike Sonko.

Speaking at an event with media editors on Saturday, June 25, the IEBC chair proposed that Parliament should consider formulating a law that allows ousted county leaders to vie for political office years after ten years.

According to the constitution 2010, Chapter six on Leadership and Integrity, impeached leaders should be permanently barred from holding any other state office.

However, if the IEBC proposal succeeds, the politicians will be allowed to make political comeback after the suspension period ends.

Currently, the politicians affected are Sonko, former Kiambu Governor Ferdinand Waititu and former Kiambu Senate Aspirant Karungo Thang’wa.

In his speech, Chebukati also mentioned that disqualified candidates won’t appear on the ballot for the General Election on August 9.

He made the declaration following the High Court’s decision that it lacked jurisdiction to hear cases involving integrity brought by contestants who had been eliminated.

After the court sent the case back to the Disputes Resolution Tribunal, Chebukati claims that it is now “water under the bridge.”

“I have not read the judgment but from what you are saying, if the court has referred back to us, it is now functus officio because we have moved on. We have finished the nominations and now we are planning to print ballot papers. We shall not revisit those issues.
