Former Kiambu Governor Ferdinand Waititu is now facing fresh criminal charges even as he serves his sentence for corruption at Kamiti Maximum Prison. 

According to reports, Waititu has been charged over statements he allegedly made at Ruiru Stadium on September 29, 2024, during a public event.

Prosecutors argue that the comments were deliberately provocative and had the potential to trigger a breach of the peace in the county.

The prosecution told the court that the remarks targeted groups, including hustlers, market vendors, boda boda operators and clergy, and were meant to incite tension.

The charges fall under Section 94.1 of the Penal Code, which deals with utterances likely to cause public disorder or violence.

The Office of the Director of Public Prosecutions is actively pursuing the matter, with the court scheduling the case for hearing next week.

This latest legal battle adds to the mounting challenges facing the former county chief, who continues to serve his time at Kamiti Maximum Prison while fighting multiple legal fronts.

Waititu’s current imprisonment stems from a corruption conviction handed down in February 2025, where he was found guilty of misappropriating public funds.

The court determined that he had failed in his duty to protect taxpayer money after irregularly receiving Ksh25 million from a private company following what was ruled as an unlawful tender process.

The former governor was given two options: pay a substantial fine of Ksh53.5 million or serve a 12-year prison term. Unable to meet the financial penalty, Waititu began serving his sentence at Kamiti Maximum Prison.

His attempts to secure more favorable bond terms have been unsuccessful.

In October 2025, High Court Justice Lucy Njuguna denied his application to replace a Ksh53 million bank guarantee with cash deposits. Justice Njuguna noted that Waititu’s legal team had made similar requests on three previous occasions, and allowing such applications would only delay the judicial process.
