Motion to impeach Agriculture CS Mithika Linturi introduced in Parliament over fake fertiliser saga.

On Thursday, April 25, Bumula Member of Parliament Jack Wamboka filed a resolution to remove Agriculture Cabinet Secretary Mithika Linturi from office.

The senator brought up several concerns about Linturi’s ministry during a news session, including the sugar scam and the phony fertilizer.

Under the Cabinet Secretary’s supervision, fake fertilizer was released to the public, which alarmed the MP for Azimio. He also brought up the sugar crisis, in which consumers were given inappropriate imported sugar.

The lawmaker announced that he has collected 110 signatures in favor of his impeachment move and that he expects Speaker Moses Wetangula of the National Assembly to swiftly approve the motion.

If the motion is accepted, it will be discussed in the House, where members will decide what happens to him.

“You’re well aware of the happenings in this country and the fertilizer scandal and what we have been experiencing, the drama around it. This is not the first time we’ve had scandals around CS Linturi,” stated Wamboka.

“I want to draw your attention to the sugar scandal where sugar imported was not fit for human consumption and it was released to the public,” he continued.

Wamboka has detailed several charges, including flagrant misbehavior, severe violation of the Constitution, and breach of public trust.

“As we speak today, in light of the recent events, it is with deep concern that I announce the introduction of a motion to impeach CS Linturi,” Wamboka remarked.

“The motion is rooted in gross misconduct, violation of constitutional provisions and serious breaches of public trust. The evidence presented before the Assembly paints a distressing picture of negligence, mismanagement and potential criminal activities within his ministry.”

The lawmaker stated that the CS has let Kenyans down by sabotaging the goal of achieving food security and urged his colleagues to support his motion for the duration of the process.

How a CS Can Be Impeached:

A legislator supported by at least 25% of MPs may make a motion mandating the President to remove a CS, in accordance with Article 152 (6) of the Constitution.

The motion and a list of supporting MPs must be submitted by the MP to the Clerk of the National Assembly. After that, the Speaker will receive the motion from the Clerk to be discussed in front of the House.

Within 14 days after the notice is sent, the MP must make the motion. If the resolution has the backing of at least one-third of the National Assembly, an 11-member committee will be created to look into the claims within ten days.

The committee provides the National Assembly with a thorough report after the investigation. The Cabinet Secretary is then called to Parliament to give evidence in front of the Committee.

The Cabinet Secretary may make their case before Parliament if any of the charges are found to be true.

The Speaker presents a resolution to the President suggesting the CS’s termination if the MPs find fault and approve of the impeachment.
