Raila wins as High Court declines to issue orders to stop mass demonstrations called by the Azimio coalition.

The High Court has declined to issue orders stopping the nationwide anti-government protests being led by Opposition leader Raila Odinga.

Justice Hedwig Ongundi also declined to issue orders to Inspector General of Police Japhet Koome to arrest the demonstrators.

In the case, the lawyer representing former Nairobi Governor Mike Sonko had argued that the demonstrations have caused a lot of disruptions adding that businesses have been affected.

In giving its ruling, the court said that it can’t direct two senior officers who have the mandate to arrest, citing separation of powers.

“It would therefore not be proper for these courts to appear to be setting out new regulations and policies which is not within its docket,” the court noted

High Court further declined to issue orders to Inspector General of Police Japhet Koome to arrest the demonstrators noting that it did not have the authority to direct the Interior Cabinet Secretary Kithure Kindiki on who to arrest.

On the matter of the illegality of the declaration of public holidays by the Azimio leader Raila Odinga, the court stated that the Interior CS and the Inspector General of the police would direct on the way forward. 

The lawyer representing former Nairobi Governor Mike Sonko stated that the weekly demonstrations caused disruptions and affected businesses across the country.

Sonko’s petition additionally claimed that the Monday, March 20, protests were aimed at forcing President William Ruto out of office.

Meanwhile, Azimio leader Raila Odinga has condemned the invasion of East Africa Spectre Limited along Mombasa Road and the Kenyatta family-owned land along the Eastern Bypass, Ruiru.

Raila described the acts as those of cowardice.

“Wale wanakwenda kuvamia shamba za wengine na viwanda, Wale ni waoga (Those invading other people’s lands and companies. Those are cowards),” he said.

However, Raila maintained that the Azimio outfit will remain firm in its stance.

He urged Azimio supporters to show up for peaceful demonstrations on Thursday.
