The Law Society of Kenya and the Katiba Institute on Monday served President Ruto, Public Service Commission with court orders barring CASs from taking office.

The two organizations had previously filed a Constitutional Petition in the High Court of Kenya in an attempt to bar 50 CASs from assuming office.

Justice Ongúdi granted Conservatory Orders on 24th March 2023 in which the CASs were barred from assuming or continuing to act as Chief Administrative Secretary until the Hearing of the case.

The respondents – the President and the Public Service Commission, and the 50 CASs as interested parties, – have already been served with the orders.

The orders prohibit the CASs from earning any salary, remuneration, or any other benefit until the court decides on the matter.

The 50 interested parties, who are named in the petition, may obtain copies of the Petition and Application from the High Court, Constitutional and Human Rights Division.

The case is set to be mentioned on 21 April 2023.

This comes after a report from the petitioners that some of the CASs had assumed their positions in defiance of the court’s order.

However, on Friday, March 31, Judge Hedwig Ong’undi sternly warned the news CASs appointees and referred the matter to Chief Justice Martha Koome.

Ong’udi emphasized the importance of adhering to court orders until they are overturned and urged the CASs’ legal counsel to do the same.

“Court orders once issued must be obeyed until they are set aside. We may be happy with them or not but obedience is key. Kindly lawyers for the CASs pass that message to your client,” the judge stated.
