A dramatic scene unfolded outside the Milimani Law Courts on Tuesday following the hearing of a case against Trans Nzoia Governor George Natembeya, when several members of his team were allegedly arrested by unidentified individuals.

According to a statement shared by the DAP-K party, those seized included Sinyereri Ward MCA John Chigi Makhanu, the governor’s personal assistant Emmanuel Wanjala, Director of Communications Felix Sialo, Nawiri Programme Chairman Martin Waliula, and Protocol Officer Dean Frank.

They were reportedly bundled into unmarked Subaru vehicles by plainclothes men in full view of police officers stationed at the court premises, who took no action to stop or respond to the incident.

A video shared by the DAP-K party on their X platform appears to show the forceful arrests of people said to be staff of the Trans Nzoia County Government.

The incident came just after a court session in which the prosecution admitted it had failed to comply with a previous order to provide the defence with all materials it intends to rely on in the case against Governor Natembeya.

The court has now directed the prosecution to share all relevant evidence by June 16, when the matter will next be mentioned.

“Those documents and statements ought to have been supplied by now… I therefore direct the prosecution to comply with the earlier orders,” the magistrate ordered.

The prosecution, through State Counsel Victor Awiti, requested an additional two weeks, saying, “Most of the documents are to be obtained from Trans Nzoia County, and we have been unable to access them. We are requesting an additional two weeks to comply.”

However, the defence rejected the application, calling it an abuse of the court process.

“Why would they visit the county offices without informing us, so that our legal team could be present? Now they are asking for more time. That is not how the criminal justice system operates — you do not charge someone first, then begin looking for evidence,” the defence argued.

Governor Natembeya is facing three charges: unlawful acquisition of public property, conflict of interest, and indirectly benefiting from public funds.
