Supreme Court rejects Ruto’s application on LSK and four dissenting IEBC commissioners on Raila Odinga’s petition.
President-elect William Ruto has suffered a setback as the Supreme Court denied both of his petitions that sought to overturn his election.
Prior to the pre-trial on Tuesday, August 30, the Supreme Court denied Ruto’s request to prevent the Law Society of Kenya – LSK from being enjoined in the presidential case.
He had argued that LSK could not be neutral since Azimio’s running mate, Martha Karua, is a member and former leader of the society.
Erik Theuri, the LSK president had submitted an application to be included in the petition as an impartial advisor (amicus curiae), claiming that the organization has the necessary experience to help the nation’s highest court render an appropriate decision.
In his second application, William Ruto, through his legal team, challenged the affidavits filed by four dissenting IEBC commissioners.

Independent Electoral and Boundaries Commission (IEBC) commissioners Wafula Chebukati, Juliana Cherera, Abdi Guliye, Boya Molu, Justus Nyang’aya, Francis Wanderi, and Irene Massit each filed their petitions in Raila Odinga’s case challenging election results.
Ruto through Kindiki said that IEBC vice-chair Cherera, Massit, Wanderi, and Nyang’aya are at odds with IEBC Chairman Wafula Chebukati and plan to use his response to promote charges, fresh assertions, and innuendoes that are only meant to prejudice Ruto.
Ruto had argued that the affidavits filed by the commissioners created a second-tier petition despite them being considered as respondents in the case challenging his win.
However, the Supreme Court has rejected Ruto’s application meaning that their affidavits would be inadmissible.
In their affidavits, the four dissenting commissioners argued that the August 9 presidential election was not transparent.
They argued that the commission chairperson Wafula Chebukati sidelined them and announced Ruto as President-elect without verifying some results.
Chebukati, in his affidavit, defended IEBC, noting that the agency conducted the Presidential poll in a fair and credible manner.
