President William Ruto’s Lawyer Kamotho Njenga announced that he had withdrawn from the Rigathi Gachagua impeachment case.
Speaking before the three-judge bench on Thursday, October 24, the lawyer informed Justices Eric Ogola, Freda Mugambi and Anthony Mrima that he had filed a notice to cease representing the Head of State.
He explained that the decision was informed by a Supreme Court decision in 2022 where it was ruled that civil proceedings cannot be initiated against a sitting President.
The impeachment case is a civil proceeding given it is between Gachagua and various State officials and agencies such as the Senate and the National Assembly.
“For record purposes, I wish to bring to the attention of the Court that we shall no longer be acting for the 6th respondent in this matter and to that effect we have filed a notice to cease acting on account of the Supreme Court decision that determined that the President cannot be subject to civil proceedings,” the lawyer informed the Court.
“In that regard, we will not act contrary to court orders. The sixth respondent is not unrepresented.”

Ruto had been listed as the 6th respondent in the petition filed by impeached Deputy President Rigathi Gachagua challenging his removal from office.
Gachagua had sued the Speakers of the National Assembly and the Senate alongside the respective houses owing to the procedure undertaken during the impeachment process.
The impeached DP is seeking to have the decision overturned and block Ruto and Parliament from replacing him.
Already, Kithure Kindiki was picked as the DP nominee and consequently approved by the National Assembly.
