Court rejects Alfred Mutua’s application to leave the Azimio la Umoja One Kenya Coalition.
Maendeleo Chap Chap Party leader Alfred Mutua’s bid to leave the Azimio coalition has been denied by the High Court.
According to the high court ruling on Wednesday, June 8, the court ruled that the applicant failed to pursue internal dispute resolution, and thus his desire to quit the coalition was denied.
The decision follows a previous finding by the Political Parties Disputes Tribunal, which dismissed Maendeleo Chap Chap’s bid to leave the Azimio coalition.
The tribunal dismissed the application filed by the MCC party arguing that it lacked jurisdiction to hear the cases as the applications were prematurely filed before it.
“We find that the matter by the complainants before our jurisdiction was prematurely invoked.
The preliminary objection by Azimio La Umoja Party and Registrar of Political Parties is merited and upheld. The application by the petitioners is struck out,” the tribunal ruled.
Alfred Mutua went on to join Kenya Kwanza and he announced his support of Deputy President William Ruto’s candidature for the presidency in the August polls.
The Machakos governor stated that he decided to join Kenya Kwanza after Azimio failed to disclose the coalition agreement signed with affiliate parties.
“As you can see, we have been kicked out of Azimio… you cannot sign a contract and no one gives it to you,” he stated.
However, the tribunal disputed the argument that MCC was not aware of the content of the coalition agreement noting that it’s hard to accept the assertion.
“No evidence was tabled demonstrating that they asked the registrar of political parties to furnish them with the document. That argument cannot be used as a ground of exit,” the tribunal stated.
