Lawyer Njeri Maina has vowed to challenge the High Court’s judgment on former Deputy President Rigathi Gachagua’s impeachment, insisting that the case was never about financial compensation but about defending the Constitution and the rule of law.

Njeri expressed dissatisfaction with parts of the judgment and signalled that the legal battle would continue at the Court of Appeal.

Njeri indicated that Gachagua’s legal team was prepared for the next phase of the case.

“We cannot allow this to pass. Future proceedings will be guided by such judgements, and it is unfortunate. As they say, when the going gets tough, the tough get going, and we shall get going,” she said.

Her remarks came after the High Court upheld Gachagua’s impeachment but awarded him Sh50 million in damages after finding that his rights were violated when the Senate declined to grant an adjournment sought by his legal team.

However, she dismissed suggestions that the compensation represented a victory for the former Deputy President.

“We are not here for the money. It is not about the money. It is not about the money. It is about the integrity of the Constitution of Kenya. It is about the integrity of the processes that are undertaken by our institutions that are governed by law,” she said.

She stated that neither she nor Gachagua viewed the case through the lens of monetary compensation.

“I am certain because I know Rigathi Gachagua very well; he would not even take that. We did not come to court to get awarded money. We came here for justice. We came here to defend the rule of law and the Constitution that Kenyans passed in 2010,” Maina said.

Addressing questions on Gachagua’s absence from court during the delivery of the judgment, the lawyer said the former Deputy President followed the proceedings from home alongside his family.

Maina also revealed that security concerns and speculation surrounding the outcome of the case influenced the decision for Gachagua to stay away from court.

“Our client was watching from home with his family. The legal representatives were all here. It is not mandatory that the client attend.

Given that there was propaganda that perhaps there could be something planned, we would not want him implicated in anything,” she said.

She described Gachagua as a peace-loving Kenyan and said he had urged his supporters to remain calm regardless of the outcome of the case.

“He has called upon all his supporters to accept whatever outcome of today’s judgement, knowing that we shall proceed to the Court of Appeal and maintain peace and order,” Maina said.
