Supreme Court Judges sets 9 issues to determine Raila’s presidential petition
Supreme Court Judges led by Chief Justice Martha Koome has set 9 issues to determine Raila’s presidential petition.
During the pre-trial conference on Tuesday, August 30, Chief Justice Martha Koome outlined nine concerns the Supreme Court will address in the Presidential petition.
9 issues listed by Supreme Court Judges;
Whether the technology deployed by IEBC for the 2022 General Election met the standards of integrity, verifiability, security, and transparency to guarantee accurate and verifiable results
Whether there was interference with uploading and transmission of Forms 34A from polling station to IEBC public portal.
Whether there was a difference between Forms 34A uploaded on IEBC public portal and Forms34 A received at the national tallying centre and Forms 34 A issued to agents at polling stations.
Whether the postponement of Gubernatorial Elections in Kakamega and Mombasa Counties, Parliamentary elections in Kitui Rural, Kacheliba Rongai, and Pokot South Constituencies and electoral wards in Nyaki West in North Imenti Constituency and Kwa Njenga in Embakasi South Constituency resulted in voter suppression to the detriment of Azimio la Umoja Presidential candidate Raila Odinga and his running mate, Martha Karua.
Whether there were discrepancies between votes cast for presidential candidates and other elective positions.
Whether IEBC carried out verification tallying and declaration of results in accordance with the provisions of Article 138 (3c) and Article 138 (10) of the Constitution.
Whether Ruto, the declared president-elect attained 50 percent +1 in accordance with Article 138 (4) of the Constitution.
Whether there were irregularities of such magnitude as to affect the final results of the presidential election.
What reliefs and orders can this court (Supreme Court) issue?
The Supreme Court Judges will base on the nine issues to deliver a verdict slated for September 5.
