DPP declines to charge blogger over social media post criticising DIG Eliud Lagat

The Office of the Director of Public Prosecutions (ODPP) has declined to press charges against blogger Kelvin Moinde over a social media post that allegedly criticised Deputy Inspector General of Police Eliud Lagat. 

In a statement on Monday, June 9, the ODPP confirmed that it had received and reviewed the inquiry investigation file on Moinde but found no basis to proceed with prosecution. 

“The Office of the Director of Public Prosecutions (ODPP) acknowledges receipt of the inquiry investigation file on Mr. Kelvin Moinde. 

“Upon careful perusal of the inquiry file, the Director of Public Prosecutions (DPP) is satisfied that there is no sufficient evidence to charge Mr. Kelvin Moinde,” the statement read. 

Moinde and Albert Ojwang, who died in police custody at the Central Police Station, were arrested in Kisii and Homa Bay, respectively, over social media posts allegedly criticising Lagat.

In a media briefing earlier Monday, the Inspector General of Police, Douglas Kanja, confirmed that Ojwang was arrested following a complaint lodged by Lagat.  

Kanja confirmed that the arrest was linked to allegations of defamation made by Lagat.  

“The reason as to why the late Albert Ojwang was arrested, together with a few others, is because there was a complaint that had been lodged by the Deputy Inspector General of the Kenya Police Service (KPS), Eliud Lagat.

“The complaint was about his name being tarnished; it was on that basis that investigations were being carried out because he (Lagat) also has a right to be protected by the same law,” he said.
