Azimio lawmaker, Robert Mbui claims “2027 election is predetermined” after the court decision that allowed the recruitment of IEBC commissioners.
Robert Mbui, a member of parliament from Kathiani, has taken issue with the High Court’s decision to grant permission for the hiring of new commissioners for the Independent Electoral and Boundaries Commission (IEBC).
Judge Mugure Thande of the High Court directed the selection panel to continue with the process, stating that the bipartisan negotiations committee’s political ceasefire does not supersede the Constitution.
Mbui contested the court ruling during a panel discussion on Citizen TV on Monday, claiming it will give the Kenya Kwanza coalition party more influence than the other parties.
“For a judge to make a decision and say that ‘proceed’ it means that already the 2027 election is predetermined. That is what we are fearing,” said Mbui.
The MP emphasized that all three levels of government must respect one another and that the court should refrain from making decisions on issues that are up for debate in parliament.
“One of the deliberations from the NADCO report was to tell the selection panel to stop and await the outcome of the process that brought all these players together,” he said.

On the same platform, Narok Senator Ledama Ole Kina said that Azimio is not happy with the High Court decision.
“We have an option, we move to the court of appeal, coz it’s a High Court decision, and present evidence that this is a matter that is alive in parliament that is trying to bring a balance on the players and also community order,” Ledama said.
The High Court had ruled on February 1st that the IEBC selection process begins immediately.
“I reject the notion that the political question doctrine should override the very explicit constitutional provisions and that the prevailing circumstances should be allowed to infringe on the rights enshrined in the Constitution,” Justice Mugure Thande ruled.
Azimio leader Raila Odinga has also trashed the High Court’s ruling terming it hogwash.
“That is hogwash. Until Wandayi and Kalonzo’s report goes through Parliament, we cannot begin to speak about IEBC. As for the cost of living, our demand for lowering it remains,” Odinga said on Sunday.
