The Judicial Service Commission (JSC) has hated the processing of petitions seeking the removal of Chief Justice Martha Koome and other Supreme Court judges from office

The Judicial Service Commission (JSC) has hated the processing of petitions seeking the removal of Chief Justice Martha Koome and other Supreme Court judges from office.

In a statement on Tuesday, February 25, JSC Vice Chairperson Isaac Ruto said the commission is restrained from processing the petitions interim conservatory orders were issued, barring the JSC from further processing the petitions.

“In view of the foregoing, and in compliance with the prevailing court orders, the JSC is now restrained from processing the subject petitions or commenting on the ongoing court cases.

“The JSC, in promoting and facilitating the independence and accountability of the Judiciary, shall therefore defend the matters in court and assert its mandate to exercise its constitutional functions under Articles 168, 172, and 252 of the Constitution,” read the statement in part.

The JSC Vice Chairperson reiterated that the commission is committed to respecting the rule of law.

“We reiterate the Commission’s commitment in respecting the rule of law and discharging its mandate without fear, favour or ill-will,” Ruto added.

This comes eight cases were filed in the high court by CJ Koome, Justice Philomena Mwilu, Justice Njoki Ndungu, Justice Mohammed Ibrahim, Justice William Ouko, Justice Isaac Lenaola, and Periken Ole Esho.

Former Law Society of Kenya (LSK) President Nelson Havi in January filed a petition with JSC seeking the removal of Supreme Court judges over allegations of gross misconduct and misbehavior.

Havi took issue with the Supreme Court’s decision to bar Senior Counsel Ahmednasir Abdullahi from appearing before the apex court.
