Former Kiambu Governor Ferdinand Waititu has been released from the Kamiti Maximum prison following the latest court ruling.

The governor was released on Thursday, March 5, after the court reviewed his bail terms pending the hearing of his Ksh588 million graft case.

The Milimani High Court approved his application last month to review his bail terms to Ksh20 million, down from over 50 million that had been requested earlier.

In addition to the Ksh20 million in cash, the court also set two sureties with property security that are valued at not less than Ksh30 million each.

Waititu ‘s lawyer had earlier indicated that the former county chief had been unable to secure a bank guarantee as part of his previous release conditions due to the ongoing case.

“I am holding brief for the appellant who is now a free man ”Waititu’s lawyer, Jeremy Njenga, told the court on Thursday.

Waititu was convicted in February for failing to safeguard public funds after allegedly irregularly receiving Ksh25 million from a company following an unlawful tender award.

The court ordered Waititu to either pay a fine of Ksh53.5 million or serve 12 years in prison.

In his ruling in February, the Milimani Anti-Graft Court Chief Magistrate Thomas Nzioki noted that Waititu’s conduct could not be forgiven since his actions while in office undermined the tenets of good governance.

During the same time, Waititu’s wife, who was also involved in the graft case, Susan Wangare,  was ordered to pay a fine of half a million or serve a sentence of one year in prison. 

Waititu has been having run-ins with the prosecutorial agencies over graft allegations since his exit from office in 2019.

In the ruling delivered on Tuesday, September 16, Njuguna declined Waititu’s application to overturn his 12-year imprisonment sentence,  after she determined that the former Governor’s appeal lacked proper grounds.
