Gachagua allies get court orders over looming arrest
Some allies of Deputy President Rigathi Gachagua got conservatory orders barring the police from arresting them.
In orders issued by Justice Lawrence Mugambi on Friday, September 27, the police cannot arrest former Nyeri Town MP Ngunjiri Wambugu and Former Embakasi West MP George Theuri until their petition is heard and determined.
The allies of the DP moved to court after the Office of the Directorate of Public Prosecution (ODPP) approved charges that had been levelled against them regarding the financing of the June protests.
“I have read the Notice of Motion dated 27th September 2024, the Certificate of Urgency of even date and the supporting affidavit sworn by Ngunjiri Wambugu, and thus issue the following order and directions,” the judge ordered.
“That pending the hearing and determination of this application, this court hereby issues a conservatory order restraining the respondents whether by themselves, their officers, servants, agents or acting on their behalf from arresting, detaining, confining, prosecuting or in any other way interfering with the liberty of the Petitioner/ Applicants arising out from the allegations raised in this petition.”
The matter will be mentioned in court on October 15, 2024.

In the meantime, Gachagua has called out the state agencies such as the DCI for being used to fight him and leaders associated with him.
According to the DP, people behind his impending impeachment are planning on using the charges against his allies as grounds for his impeachment.
“This evil scheme is to associate them with violent demonstrations that took place in late June, in a futile attempt to soil my name and hopefully create grounds for the mooted impeachment proceedings against me,” Gachagua’s statement read in part.
“Kenyans are very intelligent people. They know what factors made the People of Kenya take to the streets. Kenyans also know what the real problems in Kenya are. They surely know Rigathi Gachagua is not among them.
