Ruto through Office of the Data Protection Commission (ODPC) goes after 40 mobile lenders calling relatives and friends to recover loans.

40 Digital Credit Providers (DCPs) whose procedures for the processing of personal data have been reported are the subject of an audit, according to the Office of the Data Protection Commission (ODPC).

The move comes after complaints by Kenyans that their personal data was breached by the mobile lenders through relatives of loanee in a bid to recover their loans

The Office of the Data Protection Commission listed the names of the mobile lenders in breach of procedures which include; Branch, AsapKash, Kashway, Ipesa and Lemon Kash, Zuri Cas,Tala, Zenka Digital Limited, SkyPesa, Senti, Zash loan, Wakanda Credit/Kashway, Rocket Pesa, and Premier Credit ltd.

Others include; Pocket Cash, PapCash, Metaloan, LionCash/Grola Tech ltd, Lemon Kash, KesLoan, KashWay, KashPlus and KashBean are also on the Data Commissioner’s radar.Immaculate Kassait’s office is also going after Apesa/Zerox Technology Company Ltd, Cash, Cash sea, Collect Plus, Coopesa, Credit Kes, Credit Moja, Deltech Capital Limited/Mykes loan, Direct Kash, Fair Kash, Flashpesa

 and Flexi Cash.

Also on the list are Hela Credit, Hikash, IKASH Connect, Instracahs, Ipesa and Kash loan.

The Director of ODPP, Immaculate Kassait stated that during the audit process, the aforementioned lenders will be required to provide the Office with requisite documents by October 18, 2022 failure to which they will be deemed to have failed to cooperate with the Office which is an offence under Section 61 of the Act.

Kassait also reiterated ODPC’s commitment to protect personal data and enforce compliance in the event of a breach of the laws.

“This is just one among many other complaints being investigated by the office. We want to assure the public that the complaints received will be investigated and concluded accordingly,” she stated.

The move by ODPP come after President William Ruto during his inauguration said the government will review the Credit Reference Beareu framework from its current practice of arbitrary, punitive and all-or-nothing blacklisting of borrowers.
