High Court orders Worldcoin to delete biometric data collected from Kenyans

The High Court has ordered Worldcoin to delete the biometric data of Kenyans that it unlawfully collected using its orb in September 2023. 

The activity will be under the supervision of the Office of the Data Protection Commissioner (ODPC). 

The Court also prohibited the company from further processing such data without conducting an adequate Data Protection Impact Assessment or obtaining valid consent.

During the hearing, the Office of Data Protection argued that the processing of the personal data through Worldcoin project does not adhere to the principles of data protection as set out in section 25 of the Act.

The office asked the court to intervene failure to which Kenyans’ personal data mined during the Worldcoin project will be erased and modified. 

In an affidavit, Deputy Data Commissioner Oscar Otieno said that having reviewed the Worldcoin project operations in the country, he was satisfied that it is not safe for Kenyans.

Worldcoin operations were banned in Kenya after the crypto firm had collected biometric data of thousands, who were given 50 USD in return. 

In 2024, Worldcoin, owned by techpreneur Sam Altman, announced its return to Kenya.
