DPP opposes bail for 74-year-old Kenyan wanted in the U.S

The Office of the Director of Public Prosecutions has opposed the release on bail of a 74-year-old Kenyan man wanted in the United States to face multiple cybercrime-related charges.

The suspect, Godfrey Mbogori, is sought by authorities in the United States District Court for the Eastern District of Virginia following a warrant of arrest issued on November 15, 2023.

According to prosecutors, Mbogori faces charges of conspiracy to commit computer intrusions, conspiracy to commit wire fraud, and aggravated identity theft, offences under Title 18 of the United States Code.

He was arrested on February 19, 2026, in Meru by officers from the Anti-Terrorism Police Unit and the Joint Anti-Terrorism Task Force following an INTERPOL Red Notice.

The prosecution, led by Senior Deputy Director of Public Prosecutions *Vincent Monda, told the court that the Office of the Director of Public Prosecutions received a formal extradition request on February 26, 2026.

Opposing bail, prosecutors cited the seriousness of the offences and the likelihood that the suspect could abscond if released.

The Director of Public Prosecutions (DPP) has opposed the release on bail of a 74-year-old man wanted in the United States of America for criminal trial.

“The respondent was arrested pursuant to an INTERPOL Red Notice, and the prosecution has already received a formal extradition request from the United States,” the prosecution stated in court.

They further argued that Kenya must uphold its international obligations in fighting cross-border crime.

“Kenya has international obligations to cooperate in the suppression of transnational crime, and granting bail in circumstances where a suspect is a subject of an active international warrant of arrest request may undermine the integrity of extradition proceedings and Kenya’s international law obligations,” the prosecution told the court.

The court is expected to determine whether Mbogori will remain in custody as extradition proceedings continue.
