Government issues 30-day ultimatum to Kenyatta family-owned Brookside company

The National Environment Management Authority (NEMA) flags 29 companies including Brookside Company for polluting the Nairobi River.
The National Environment Management Authority (NEMA) on Wednesday, January 31, unleashed a list of 29 companies accused of polluting the Nairobi River.
In a statement to newsrooms, the companies among them Brookside Dairy Limited and Unilever Kenya Limited, have been given 30 days to clean up their waste and submit a plan for waste management.
“NEMA carried out inspections at various points within the Nairobi River catchment on January 18, 2024. The inspection team established that there were assorted synthetic wastes, along the river part which bore the identity of different producers.
“It was also established that the waste had accumulated in the rivers interfering with their flow, posed a potential threat of flooding, and water pollution and are likely to have adverse environmental effects on the general environment,” read the statement in part.
Additionally, apart from cleaning the river, the companies were directed to file a report on the cleaning exercise.
“Each of the 29 companies polluting Nairobi River is expected within 30 days to clean up the wastes within the specific sites where the crime was committed to their natural state and submit to NEMA the EPR plan for the management of waste emanating from their products and packaging for Nairobi River catchment region,” part of the statement read.
The Sustainable Waste Management Act, of 2022 requires that every producer shall bear extended producer responsibility obligations to reduce pollution.
A person who fails to manage waste in accordance with this Act shall be required to clean up and restore the site to its natural state.
