Conspiracies in the Judiciary as the High Court drops Waititu corruption case while upholding those of Kimunya and John Waluke

The conspiracy that Judiciary is being used by Govt to persecute opposition allied politicians while favouring pro-government has gained momentum after the High Court ruling today.

Jubilee MP Walukhe’s appeal flopped, Jubilee’s Kimunya acquittal was reversed, while UDA’s Waititu corruption case was dismissed. 

All the rulings were made on Thursday, 6, October.

Former Kiambu Governor Ferdinand Waititu’s Ksh588 Million graft case was dropped over lack of enough evidence.

The High Court ruled that the prosecution failed to table evidence to prove beyond reasonable doubt that Waititu embezzled public funds through proxies and kickbacks. 

Waititu who was impeached in January 2020, had been charged with the irregular award of a Ksh.588 million road tender.

In another corruption case, High Court Judge Esther Maina on Thursday, October 6, dismissed Waluke’s appeal and his business associate, Ms. Grace Wakhungu, contesting a ruling where he was sentenced over a Ksh297 million scandal involving the National Cereals and Produce Board (NCPB).

Justice Maina upheld the ruling issued by Chief Magistrate Elizabeth Juma, stating that the prosecution had proved beyond any reasonable doubt that Waluke took part in the NCPB fraud.

Should the MP fail to pay the fine, he will lose his seat and a subsequent by-election will be held to replace him.

Consequently, Mr. Waluke will now serve 67 years in jail while Ms. Wakhungu will serve 69 years for fraud. 

In addition, the court overturned former Kipipiri MP Amos Kimunya’s acquittal in a Ksh60 million fraudulent case.

The ruling quashed an earlier decision by the Anti-Corruption Court that had acquitted the politician of fraud-related charges including illegal transfer of land.

With the ruling, Kimunya is set to face a fresh trial after the High Court ruled that he was wrongly freed over insufficient evidence.

Kimunya had been accused of six counts of abuse of office and illegally allocating public land to a private entity.

Kimunya was accused alongside two other individuals of a controversial land transfer executed on June 30, 2005, when he served in the Ministry of Lands.

He was accused of allocating public land to Midlands Limited, a firm associated with him, during his stint as Lands Minister in former President Mwai Kibaki’s administration.

The 25-acre land parcel allocated to Midlands Limited was worth an estimated Ksh60 million.

However, Kenyans have raised concerns over the High Court ruling questioning the independence of the Judiciary.

DAP-K Party wrote; Waluke, who is serving his fourth term as a lawmaker, is currently out on bond granted by the court. Independent now “dependent” institutions @IEBCKenya, @EACCKenya, and the hot air @Kenyajudiciary have turned into political soothers for the Pro-government suspects with corruption cases and apprehending those aligned to Azimio. Waititu- Cleaned Waluke and Kimunya- guilty.
