Senator Danson Mungatana files censure motion against DP Rigathi Gachagua in the Senate.

Tana River Senator Danson Mungatana has filed a censure motion against Deputy President Rigathi Gachagua over what he termed as unacceptable conduct.

The senator, popularly referred to as the crocodile eater, argued that the deputy president’s conduct has been wanting given the office he holds.

According to the notice of the motion moved by Senator Mungatana, the deputy president has a constitutional obligation to adhere to the general leadership and integrity code for state officers. 

“Article 260 of the constitution categorizes the deputy president as a state officer whose conduct and behaviours shall abide by the provisions of Article 75 of the Constitution of Kenya and the general leadership and integrity code for state officers contained in the Leadership and Integrity Act,” read the notice of the motion in part.

In his motion, Senator Mungatana argued that the holder of the office of the deputy president is mandated to be the principal assistant to the president whose office is a symbol of national unity.

As such, the holder of the office of the deputy president is bound by the constitution to respect the office of the presidency to promote the unity of the country.

Senator Mungatana is concerned about the remarks made by Deputy President Rigathi Gachagua which he argued showed disrespect for the state and the office of the presidency.

In the petition, Senator Mungatana claimed that since his assumption to the office of the Deputy President, Gachagua has made utterances among others regarding employment opportunities to Kenyans in the public service, allocation of resources to the devolved units and incitement of a section of Kenyans to disobey lawful directives by some county governments.

The senator, therefore, wants Gachagua to undergo a censure because his public utterances have heightened tensions among ethnic communities in Kenya.

He termed the conduct of Deputy President Rigathi Gachagua as being against the national values and principles of governance espoused in Article 10(2) of the Constitution and demeaning to the high office of the Deputy President of the Republic.

The notice motion by the senator comes barely a day after Gachagua pointedly warned President Ruto to shun betrayal politics and put his house in order.

This follows talks of impeachment of the deputy president that has been making rounds in the country. A faction of the United Democratic Alliance (UDA) party is in support of the impending impeachment.
