Wetangula initiates the process to kick out four IEBC commissioners; Cherera and the Co

Wetangula, the National Assembly Speaker initiates the process to kick out four IEBC commissioners; Cherera and the Co for rejecting election results.

Four Independent Electoral and Boundaries Commission (IEBC) commissioners who differed with the results of the presidential election on August 9 will be the subject of petitions that Parliament will begin debating.

Four petitions have been filed against IEBC vice-chair Juliana Cherera, commissioners Irene Masit, Francis Wanderi, and Justus Nyang’aya for their actions during the just-concluded General Election, according to House Speaker Moses Wetang’ula.

The four contesting the results claimed Wafula Chebukati, the chairman of the election commission, arrived at the results in an opaque manner.

Article 251 of the Constitution states that Parliament will consider the petitions and if satisfied, the Speaker will send it to President Ruto to form a tribunal to investigate the commissioners.

If the tribunal is formed, the concerned commissioners will be suspended and paid half-salary, pending the conclusion of the inquiry. 

The President will have 30 days to act on the report after the tribunal makes its recommendation to him.

The Republican Party filed the first complaint against the four commissioners, alleging that by holding a rival press conference to contest the results of Mr. Chebukati’s election, the four failed to build public confidence in the position they hold.

Rev. Dennis Ndwiga, the second petitioner, is calling for the dismissal of the four on grounds of severe misbehavior and incompetence.

The third and fourth petitioners, Geoffrey Langat and Jerry Owuor, respectively, argue that the four under-fire commissioners should be fired due to flagrant constitutional violations, misbehavior, and incompetence.

Moses Wetang’ula has already directed the Justice and Legal Affairs Committee to look into the petitions and guide the House within 14 days on whether they satisfy grounds for removal of any or all the four commissioners.

He further instructed the committee to offer the affected commissioners an opportunity to respond to the petitions either in writing or orally.
