High Court summons Police Inspector General (IG) Japhet Koome over failure to arrest Defence Principal Secretary Patrick Mariru following an arrest warrant.
In its directive, High Court Judge John Chigiti ordered IG Koome to appear in court by October 25.
This comes after IG Koome failed to execute an arrest warrant against Defence PS Patrick Mariru.
PS Mariru is accused of failing to pay Ksh52 million to nine retired Kenya Defence Forces (KDF) soldiers.
The soldiers were serving under Kenya Airforce during the 1982 attempted coup.
The Court had in its ruling ordered the government to pay the soldiers the money as compensation for the torture they went through.
The former officers were detained for allegedly taking part in the August coup since they were Kenya Air Force officers while working in diverse technological disciplines at the time.

They asserted that they were subjected to torture in order to force them to make the alleged confessions.
Additionally, the former officers alleged that they were held without charge for seven months in overcrowded cells.
They claimed that were later released and dismissed from the service without any valid reason.
Aggrieved, the officers sued the State over the issue, seeking the government to pay them general damages and violations suffered.
In 2013, Justice Isaac Lenaola ruled in favour of the nine former officers and directed the State to award them Ksh55 million.
